PERSONNEL MATTERS FOR EXPATRIATE STAFF

 

Termination of Engagement
  1. Ill Health
    If the officer is compelled by reason of ill health not caused by his own misconduct to terminate his engagement, and/or if at any time the Government Medical Board certifies that he is, by reason of infirmity of mind or body, incapable of rendering further efficient service, his appointment may be terminated. He will be eligible for all the benefits (salary, bonus, gratuity, leaves, passage grant, transport of baggage, education allowances, concession passages for children at school outside Brunei) only to the date of the termination.
  2. Dismissal
    If the officer through neglect or insubordination, or from any reason, becomes unable to perform any of his duties or to follow order, or comply with the rules, in any manner misconducts himself, engaged in moral turpitude, the Government may dismiss him. On such dismissal, all rights and privileges reserved to him shall cease on the date of his dismissal. He is also liable to refunding to the Government on demand the amount paid for the passages to Brunei Darussalam for himself, his wife and children.
  3. Abandonment
    If the officer abandons the service, all rights and privileges reserved to him shall cease immediately. He is liable to refunding to the Government on demand the amount paid for the passages to Brunei Darussalam for himself, his wife and children. In addition, he shall also pay to the Government as liquidated damages a sum equal to three times total emoluments.
  4. Termination by the Government
    The Government may at any time terminate the engagement of the officer by giving him 3 month’s notice in writing or by paying him one month’s total emoluments in lieu of notice. He will be eligible for all the benefits (salary, bonus, gratuity, leaves, passage grant, transport of baggage, education allowances, concession passages for children at school outside Brunei) only to the date of the termination.
  5. Termination by the Officer
    After serving 3 months, the officer may determine his engagement by giving the Government 3 month’s notice in writing or by paying the Government one month’s salary. He is liable to refunding to the Government on demand the amount paid for the passages to Brunei Darussalam for himself, his wife and children.
